In this writ petition the petitioner is assailing the order dated 01.12.2023 (Annexure-L) passed by the competent authority-respondent No.2.

Heard Sri Gangadharaiah A.N., learned counsel appearing for the petitioner, Sri S.R.Anuradha, learned Senior Counsel appearing on behalf of Smt. Sabahath Sultana for respondents No.1 and 2 and Sri Mahmood Patel, learned counsel appearing for respondent No.4.

Learned counsel appearing for the respondents invited the attention of the court to Section 83(2) of the Waqf Act, 1955 and submitted that it is open for the petitioner to exhaust the remedy available under the law.

In that view of the matter, taking into consideration the fact that the impugned order is an appealable order, I am of the view that, no interference is called for in this writ petition. It is open for the petitioner to approach the competent Tribunal for redressal of the relief sought.
