Present petition is filed seeking quash of the impugned order dated 14.01.2016 issued by the respondent No.3 vide Annexure-A in which the petitioners have been placed under 2^nd and 3^rd categories of the

house to be allotted as per the Government Order dated

Learned counsel for the respondent -authorities submits that the categorization of the houses is made depending upon the documents furnished by the petitioners. He refers to the guidelines contained in the Government Order dated 20.06.2007 produced at Annexure-C, which reads as under;

Referring to the same, counsel for the

respondent-authorities submits that if petitioners had furnished the documents evidencing the fact that the petitioners have been residing within the land forming part

of the 1^st category, one year prior to the issuance of the preliminary notification, the case would be considered under the 1^st category. However the documents furnished by the petitioners as seen at Annexures-B to B6 would indicate that the same are within the period of one year from the date of issuance of the Notification.

At this juncture counsel for the petitioners

submits that liberty be reserved to the petitioner to furnish further documents and a direction in this regard be issued

to the respondent -authorities to re-consider the case of the petitioners.

In response, counsel for the respondentauthorities submits if the documents are furnished by the petitioner regarding they residing in the land one year prior to the issuance of preliminary Notification the same would be considered in accordance with law.

(b) Petitioners are at liberty to furnish documents and other details if any evidencing the fact of they having been residing in the land prior to issuance preliminary notification.

(c) On receipt of the same, respondent -authorities shall after heaving the petitioner, shall pass an appropriate and considered order in accordance with law, within an outer limit of three (3)
