THIS WRIT PETITION IS FILED UNDER ARTICLE 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT XXV ADDITIONAL CITY CIVIL AND SESSIONS JUDGE, BENGALURU CITY (CCH-23) TO DISPOSE OFF THE NEW VAKALATH FILED ALONG WITH AFFIDAVIT BY RESPONDENT NOS.2 TO 4 ON 25.03.2022 IN FDP.NO.137/2016 AS PER ANNEXURES-C AND D WITHIN A STIPULATED TIME FRAME.

Heard learned counsel for petitioner.

This Court does not find any need or necessity to issue notice to the respondents.

A suit for partition was filed, which came to be decreed on 19.09.2024 by the trial Court holding that the petitioner and his deceased father are entitled to 1/4^th share in the suit schedule property. Thereafter, the Final Decree Proceedings came to be filed in FDP.No.137/2016 for drawing up of the final decree and putting the parties to the respective shares and demarcation of the premises.

The father of the petitioner died on 02.05.2021. Prior to

that, he had executed a Will in favour of the petitioner

herein bequeathing the suit schedule property.

Now the Final Decree Proceedings are being protracted for one reason or the other. Hence, the petitioner is before this Court seeking to expedite disposal of the Final Decree Proceedings, as the petitioner has waited for more than 20 years from the date of filing of the suit to enjoy the fruits of the decree.

Under the circumstances, I pass the following:

i) This petition is disposed off ;

ii) The XXV Additional City Civil and Sessions Judge, Bengaluru, shall dispose of FDP No.137/2016 as expeditiously as possible not later than six months from the date of receipt of copy of this order.
