THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO A) ISSUE A WRIT OF MANDAMUS OR OTHER APPROPRIATE WRIT OR ORDER SEEKING A DIRECTION TO THE RESPONDENT NO.3 TO RECONSIDER AND REDETERMINE THE COMPENSATION, BY AWARDING INTEREST NOT ONLY ON THE LAND BUT ALSO ON THE ERECTIONS AND IMPROVEMENTS THEREON, AS ENUMERATED AT SL.NO.2 TO 5 OF THE AWARD NOTICE DATED 01.04.2025, AND TO PAY THE SAME TO THE PETITIONER EXPEDITIOUSLY, IN ACCORDANCE WITH LAW, IN TERMS OF THE REPRESENTATION DATED 18.08.2025 VIDE ANNEXURE-C IN SO FAR AS PETITIONER CONCERNED.

The petitioner has filed Writ Petition seeking a writ of mandamus directing respondent No.3 to reconsider and re-determine the compensation, by awarding interest not only on the land but also on the erections and improvements thereon, as enumerated at Sl.No.2 to 5 of the award notice dated 01.04.2025 at Annexure-B, B1 and

B2 and to pay the same to the petitioner. The petitioner also seeks consideration of his representation dated 18.08.2025 at Annexure-C.

The grievance of the petitioner is that respondent No.3, while awarding compensation, has granted interest only on the value of the land and not on the erection and improvements standing thereon. The petitioner submitted a representation dated 18.08.2025 requesting re-determination of compensation including interest on the improvement, however, the same has not been considered till date.

The learned Additional Government Advocate for the respondents submits that the petitioner’s representation will be considered in accordance with law, if a reasonable time is granted.

stand redressed if appropriate directions are issued to respondent No.3 to consider the representation. Accordingly, the following:

i. The Writ Petition is disposed of .

ii. Respondent No.3 is directed to consider the petitioner's representation dated 18.08.2025 at to Annexure-C and pass appropriate orders within an outer limit of eight weeks from the date of receipt of a certified copy of this order, in accordance with law, keeping in view Section 80 of the Right to Fair Compensation and Transparency in Land Acquisition Act, Rehabilitation and Resettlement Act, 2013.
