Heard learned counsel for petitioner.

This Court does not find any need to issue notice

to the respondent as no relief is sought against the respondent nor any adverse order is passed against the respondent.

The present petition is filed by the

petitioner/plaintiff being aggrieved by non-passing of the orders in M.A. No.4/2023 by the Senior Civil Judge & JMFC, Kollegala.

It is the case of petitioner/plaintiff that the trial Court initially granted an exparte ad-interim order of Temporary Injunction and thereafter, rejected the application for Temporary Injunction, which is in challenge before the learned Senior Civil Judge & JMFC, Kollegala in M.A. No.4/2023.

It is vehement contention of learned counsel for

petitioner that despite lapse of two years, respondent is

protracting the matter with the malafide intention to encroach upon the passage in dispute. It is submitted by learned counsel that respondent has filed his written arguments on 13.10.2025 before the appellate Court and the matter is now listed on 3.11.2025 for reply. In the circumstances, learned counsel for petitioner submitted that the appellate Court may be directed to dispose of M.A. No.4/2023 within a period of four weeks.

In view of the fact that respondent has filed his written arguments and the matter is now posted on 3.11.2025 for reply of the petitioner, petitioner is at liberty to file his reply. The appellate Court, on consideration of the reply, if any of the petitioner and written arguments of the respondent filed earlier and the other material on record, shall dispose of M.A. No.4/2023 within a period of 15 days from 3.11.2025.

Accordingly, I pass the following:
