The captioned Writ Petition is filed seeking following

reliefs:

(a) Issue a Writ of Certiorari to quash the impugned order at Annexure-J dated 25.07.2023 and Annexure-K dated 30.05.2024 passed by the respondent by declaring the same as illegal besides arbitrary and erroneous.

(b) Issue a writ of mandamus directing the respondent to re-appoint petitioner back to original employment.

(c)Issue any such other writs, orders or directions as this Hon'ble Court deems fit to grant under the facts and circumstances of the case in the interest of justice.

second time and with the consent of counsel for the respective parties, it is heard.

Counsel for the respective parties urged several contentions. Heard the arguments and perused the Writ papers with care.

Suffice it to note that after completion of the probationary period, the petitioner was appointed as Driver cum Conductor in the establishment of the Corporation. It is stated that he met with an accident and sustained grievous injuries. He came under the disciplinary proceedings and was visited with an order of punishment i.e., termination of employment. The petitioner filed an appeal before the Appellate Authority and the Appellate Authority vide order dated 30.05.2024 rejected the appeal. The petitioner has questioned the order of Appellate Authority by invoking the writ jurisdiction.

The grievance of the petitioner is about rejection of the appeal before the Appellate Authority. As is evident that the petitioner is a workman and an alternate remedy is available by
