THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO (a) SET ASIDE THE ORDER DATED 19.09.2022 PASSED IN No.KEA/AOC/006/2022-23 DATED 19.09.2022 BY THE 1^ST RESPONDENT VIDE ANNEXURE-E IN SO FAR AS IT RELATES TO RECOMMENDATION TO THE STATE GOVERNMENT TO DIRECT THE MCC AND UGC TO IMPOSE HEAVY COSTS ON THE PETITIONER COLLEGE IS CONCERNED, AS ARBITRARY AND ILLEGAL AND ETC.

ORAL JUDGMENT

We have heard the learned counsel appearing for the petitioner as well as the learned counsel appearing for the KEA.

The prayers in the writ petition are as follows:

a) Set aside the order dated 19.09.2022 passed in No.KEA/AOC/006/2022-23 dated 19.09.2022 by the 1^st respondent vide Annexure-E in so far as it relates to recommendation to the State Government to direct the MCC and UGC to impose heavy costs on the petitioner college is concerned, as arbitrary and illegal;

b) Pass such other order or orders as this Hon'ble Court deems it appropriate in the ends of justice and equity.

We notice that essentially, the prayers raised by the writ petitioner are against a recommendation issued by the Admission Overseeing Committee to the Government as well as to the MCC and UGC to impose heavy cost on the college for violation of the norms, general guidelines issued by the MCC filling up stray vacancy in the petitioner-college.

Having considered the contentions advanced, we are not inclined to interfere with the recommendations of the committee or to issue any directions as sought for. However, we made it clear that before any action is taken as against the writ petitioner, appropriate steps shall be taken to issue notice to the petitioner and to consider their contentions.

With the said observations, the writ petition is disposed of.
