The petitioner has filed the present writ petition as a Public Interest Litigation praying that the directions be issued to the respondents-authorities to initiate appropriate action against unauthorised occupants and to summarily evict occupants of land falling in Survey No. 271, Byrasandra Village, Devanahalli Taluk, Bengaluru Rural District and other similar lands [ subject land ].

The petitioner claims that the subject land belongs to the Government, but has been unauthorisedly encroached. He relies on an order dated 03.08.1959 passed by the Court of Special Deputy Commissioner for Inam Abolition, Bengaluru in Case No.91/1957-58. Prima facie it indicates that land falling in Survey No.271 is reserved for public purpose. He also relies on an English translation of endorsement dated 18.09.1959, which indicates that the claims in respect to lands falling in certain survey numbers including Sy.No.271 were rejected.

We consider it apposite to dispose of the present writ petition by directing the respondent-authorities to examine the allegations made in the present petition and take such steps as they consider necessary in accordance with law.
