The petitioner, who has pledged his jewellery to

avail a loan from the respondent, has called in question the respondent's notice to bring such jewellery to sale to recover its due in a sum of Rs.38,11,193/-.

Mr. B.S.Jeevan Kumar, the learned counsel for the respondent, submits that the petition is rendered infructuous because the sale is conducted on 30.06.2025 and the jewellery is also handed over to the purchaser. Mrs. Rashmi N. L, the learned counsel for the petitioner proposes to contend that the auction could not have been held because of certain procedural lapses.

However, the petition is rendered infructuous and must be disposed of accordingly, but without prejudice to the petitioner to avail his remedy as is permissible in law.
