Petitioner is before this Court seeking for the following

reliefs:

'' a. Issue writ of mandamus or any other appropriate writ or direction quashing Impugned Meeting Notice bearing No: ಚುಅ / �ಾ�ಕ�ಪಸಸಂ�� /01/2025-26 dated

02.06.2025 thereby intimating of conducting of election for the post of President, Vice president on 12.06.2025 and consequently, direct the Respondent No.1 to 3 to defer election for the post of President, Vice president and other till disposal of Election Petition in Case No.AR27:D.D.S.:01:2025-26 filed by the Petitioner on the file of Respondent No.2 Annexure-A, in the interest of justice and equity.

b. Grant such other and further relief deems fit by this Hon'ble court in the facts and circumstances of the case.''

The Petitioner has challenged the election, where respondent Nos.5 to 17 have been elected as Office bearers of the Primary Agriculture Co-operative Society Ltd., Bisalere Village, Kadur Taluk, Chikkamagaluru District. The said Election Petition being pending, the petitioner is before this Court seeking for the aforesaid relief, for an order of restraint from holding election to the post of President and Vice President scheduled to be held on 12.06.2025.

A writ petition of the present nature is not maintainable when the Election Petition is already pending. If at all, the petitioner is seeking for any interim relief, such interim relief would have to be sought for in the said Election Petition, which is pending. Until any relief is granted in the said Election Petition, the respondent Nos.5 to 17 continue to be elected Office bearers, their election will continue to hold until they are set-aside.

As such, no grounds being made out, the petition stands

dismissed .

Learned counsel for the petitioner by referring to Annexure-K, has brought to the notice of this Court that the respondent No.2-Assistant Registrar of Co-operative Societies has issued a notice on 30.05.2025, fixing the date of hearing on 15.06.2025 at 11:00 AM, the said 15^th being Sunday, it is rather shocking that such a notice having been issued.

The Principal Secretary, Co-operative Societies Department is directed to look into the matter. If an application is
