Nataraj J), Oral Order dated 24.04.2025 in W.P.No.12144/2022 (S-RES) filed under Article 226 of the Constitution of India by 110 retired employees of the erstwhile Karnataka Dairy Development Corporation (KDDC), later taken over by Karnataka Milk Federation (KMF), seeking certiorari to quash an endorsement dated 27.08.2021 (No.Ka ha Ma/Pinchani/Aadalitha-1/2021/2422) issued by respondent No.4 (MD, KMF) rejecting their pension request, and mandamus to fix and extend pensionary benefits. Respondent No.4 had rejected the claim on the premise that the petitioners are governed by the Employer Provident Fund and the Employer Provident Fund Pension Scheme, 1995, with no provision for grant of pension by respondent No.4. ORAL ORDER

The petitioners have sought for a writ in the nature of certiorari to quash an endorsement bearing No.Ka ha Ma/ Pinchani/ Aadalitha-1/ 2021/ 2422, dated 27.08.2021, issued by the respondent No.4 by which the request for pension was rejected. The petitioners have also sought for a writ in the nature of mandamus to direct the respondents to fix and extend all pensionary benefits to the erstwhile employees of the respondent No.4.

The petitioners contend that they are erstwhile employees of Karnataka Dairy Development Corporation (henceforth referred to as ‘KDDC’ for short), which was established in the year 1975. They contend that all of them have retired from service but were not granted any pensionary benefits. They contend that many employees, similarly placed as they, claimed that they were also government servants and were entitled to be treated like government servants and were entitled to pensionary benefits paid to government servants. They all approached the Karnataka State Administrative Tribunal, seeking for directions to the respondents to grant pension. Likewise other employees approached this Court in WP.No.12527-96/2012 and connected petitions. They contend that a Coordinate Bench of this Court disposed off the writ petition, reserving liberty to produce relevant material to show that similarly placed employees were given pensionary benefits and the State Government as well as Karnataka Milk Federation (henceforth referred to as ‘KMF’ for short) were directed to consider the representation if any submitted. This was challenged in writ appeal No.247-248/2013. The Division Bench clarified that the claim of the petitioners in the writ

petition should be considered without reference to the order dated 18.07.2006 impugned therein. The petitioners contend that the state government had issued government orders extending the benefit of pension to employees similarly placed as they vide government orders dated 30.03.2010, 29.09.2010 and 15.04.2021. It is also contended that a settlement was arrived at between the management of respondent No.4 and the District Co-operative Milk Producers Societies and the Workmen and Office bearers of the dairies on 31.08.1988 when the writ petition No.10773/1988 was pending before this Court. It is claimed that the Minister of Animal Husbandry chaired a meeting and based on the settlement arrived at, the writ petition was disposed off as per the order dated 06.09.1988. The petitioners contend that they also made several representations to the State Government seeking for similar benefits and since the representations were not considered, they filed W.P.No.11224-25/2016. The said writ petition was disposed off in terms of an order dated 09.03.2020, directing the respondent No.4 therein to consider the representation that may be filed by the petitioners. The petitioners contend that they submitted a representation to the authorities on

20.01.2021, enclosing therewith a copy of the order. The respondent No.4, quite contrary to it's stand taken in the writ petition referred above, issued the impugned endorsement dated 27.08.2021 stating that there are no provisions to extend the pensionary benefits to the employees who retired from KDDC. It is contended that the respondent No.4 in W.P.No.35010-69/2011 had taken a stand that if the Government wishes to extend pensionary benefits, it had no objection and that it would remit the pension and leave sanction contribution to the Government of Karnataka. Therefore, they contend that the impugned endorsement issued by the respondent No.4 warrants interference and the respondent No.4 should be directed to reconsider the representation submitted by them.

Learned Senior Counsel appearing for the petitioners submitted that in similar facts and circumstances, a Co-ordinate Bench of this Court in W.P.No.33347/2019 had granted pensionary benefits to the erstwhile employees of KDDC and that following the said judgment, another Coordinate Bench of this Court in W.P.No.3001/2021 had granted the benefits. He contends that the petitioners are similarly

placed and therefore, they are also entitled to be treated similarly. He contends that in respect of two employees, namely Sri.D.Krishna Reddy and Sri.L.N.Bhaskar Rao, the Coordinate Bench noticed that they were also employees of KDDC, which was subsequently taken over by the Karnataka Milk Federation and that the said two employees had retired from the KMF. He submitted that the Co-ordinate Bench noticed the order passed by the Karnataka Administrative Tribunal in the case of Sri.D.Krishna Reddy and Sri.L.N.Bhaskar Rao, whereby the pensionary benefits were extended to the two employees and also that the State Government had passed an order dated 13.11.2024 to implement the order. He therefore contends that the petitioners are similarly placed and entitled to be treated similarly. In support of his contention, he relied upon the judgment of the Division Bench of this Court in the case of Nagappa vs State of Karnataka [ ILR 1986 KAR 3093] and the judgment of the Apex Court in K.K.Suresh and Others v. Food Corporation of India and Others [AIR 2018 SC 3905] .

The learned counsel for respondent

No.4/Mr.Sumanth L Bharadwaj submits that the case of the

petitioners is distinguishable from the facts in W.P.No.33347/2019. He contends that the petitioners in the decided cases were the erstwhile employees of the State Government who were posted at the erstwhile KDDC and retired from service. He contends that the petitioners in all these cases, who are all employees of KDDC, had subscribed to a provident fund and that after retirement, they were granted all the retirement benefits, including the provident fund benefit and therefore, they cannot now claim that they are entitled to be granted any pension benefits.

He also submits that the judgment of the Coordinate Bench of this Court is challenged in a writ appeal. He further contends that the impugned endorsement is issued by the respondent No.4, as the respondent No.4 has no authority to grant pension and it is only the State Government that has to consider granting pension. Therefore, the impugned endorsement cannot be assailed.

The learned High Court Government Pleader submitted that the representations of the petitioners shall be considered in accordance with law and if the petitioners are found eligible, the benefit sought for shall be granted.

I have considered the submissions of the learned Senior Counsel for the petitioners and learned High Court Government Pleader for the respondent Nos.1 to 3 and the learned counsel for the respondent No.4.

The petitioners have all contended that they were erstwhile employees of KDDC, which was later taken over by the KMF. It is not in dispute that all the petitioners have retired from the service. The question is whether they are entitled to pensionary benefits by considering them as government servants. The impugned endorsement discloses that the respondent No.4 rejected the claim of the petitioners on the premise that the petitioners are governed by the Employer Provident Fund and the Employer Provident Fund Pension Scheme, 1995 and that there is no provision for grant of pension by the respondent No.4.

If the petitioners have all subscribed to a pension provident fund, the impugned endorsement cannot be assailed, as the respondent No.4 is not the authority authorized to grant the pension. If the petitioners claim that their cases are covered by the judgment of a Co-ordinate Bench of this Court

in W.P.No.33347/2019, it is for the petitioner to make appropriate representation before the State Government namely respondent Nos.1 to 3 herein. If the cases of the petitioners are squarely covered by the judgment of this Court in writ petition referred supra, the respondent Nos.1 to 3 are bound to consider the same in accordance with law and dispose off the representation.

In that view of the matter, the writ petition is disposed off , permitting the petitioners to file a separate representation to the respondent Nos.1 to 3. If representation is filed, within one month from today, the respondent Nos.1 to 3 shall consider the case of the petitioners and pass an appropriate order within a period of three months thereafter.
