The petitioner is before this Court calling in question an endorsement dated 23.09.2017 issued by the second respondent insofar as it rejects the claim of the petitioner for bringing him into the seniority of community organizers.

Heard the learned counsel Sri. Santosh.B.Rawoot appearing for the petitioner and the learned HCGP Smt.Kirthilatha R. Patil for the respondent-State.

The petitioner is said to have been appointed as a community organizer with effect from 20.05.2022 on contract/daily wages. On 24.05.2002, in terms of the said order the appointee is said to have joined the town municipality of Gajendragad. On 28.10.2005, the State after amending the Rules, notifies the persons who are entitled to be absorbed in the respective cadres. The absorption of the petitioner is in the

cadre of Second Division Assistant and his name is found at Serial No.285 in the list of absorbed candidates. The petitioner contends that he was given the post of SDA for one day and again made to work as a community organizer and therefore he wants seniority to be depicted in the seniority of community organizers. The petitioner submitted a representation to the respondent-State to consider his case and plant him in the seniority list of the community organizers that comes to be rejected by the impugned order. In the order, the author of the order recorded the objections, filed by several persons to bring the petitioner into the fold of community organizers or a seniority list of community organizers. Owing to the objections, the claim of the petitioner comes to be rejected. The rejection of which is called in question before this Court.

A perusal of the afore quoted order impugned in the subject petition would not merit any interference at the hands of this Court for the reason that the petitioner was absorbed in the service of Second Division Assistant, in terms of the order of absorption dated 28th October 2005, as observed hereinabove. The name of the petitioner was found in Serial No.285 in the said order of absorption. If the petitioner is absorbed in the cadre of Second Division Assistant and has accepted the said order without demur, it would not be open for

the petitioner today to contend that he should come within the employees i.e. the community organizers, only because he was appointed on contract basis as community organizer in the year 2002 or he has been made to function as a community organizer, today. The law does not permit such a course to the petitioner as the absorption is in the cadre of Second Division Assistant.

The learned counsel for the petitioner submits that the benefits that would flow from the second division assistant is also not conferred upon the petitioner, If that be so, the State shall not deny any benefit for the petitioner who has been observed as Second Division Assistant, be it any kind of service benefit/s.

With aforesaid observation, finding no merit to interfere with the endorsement, petition stands disposed.
