The present intra Court Appeal has been filed impugning the judgment and order dated 24.06.2024 passed by the learned Single Judge in W.P.No. 41682/2012 (S-DIS).

For the sake of convenience, the parties are referred

to as per their rankings before the learned Single Judge.

¶38

The petitioner, who got dismissed from service of the respondent/Canara Bank for gross misconduct committed by him in using the ATM Card of one Sri. C.ChandraShekaran, whose ATM Card got stuck in the ATM Machine, while he was drawing the money, has challenged the punishment imposed on him for removing him from services and the order of the Appellate Authority upholding the said punishment in W.P.No.41682/2012 (S-DIS).

The petitioner had misused the ATM Card of Sri Chandrashekaran for an amount of Rs.68,573/-, instead of returning the said card to its owner. The documentary record clearly establishes the misconduct of the petitioner and therefore, considering the gross

misconduct committed by the petitioner, the learned Single Judge has rightly not interfered with the quantum of punishment.

We find no reasons to interfere with the impugned judgment and order passed by the learned Single Judge. Accordingly the writ appeal stands dismissed.
