THIS RPFC IS FILED UNDER SECTION 19(4) OF THE FAMILY COURTS ACT, 1984 PRAYING TO SET ASIDE THE ORDER DATED 27.02.2017 PASSED IN CRL.MISC.NO.303/2015 BY II ADDITIONAL PRINCIPAL JUDGE, FAMILY COURT, BENGALURU.

Heard the petitioner/party-in-person namely,

Smt.Sridevi K.S. and Sri Ravishankar T.P., learned counsel

The respondent-Sri B.P.Chethan and petitioner

No.2-Pramit B.C. are present before the Court physically.

Learned counsel for respondent tenders a Bankers Cheque for a sum of Rs.7,00,000/- in favour of petitioner No.2 and Rs.2,00,000/- in favour of petitioner No.1 drawn

on State Bank of India dated 16.04.2025. The said

Bankers Cheques are handed over to the petitioners, who

are physically present before the Court and the same is acknowledged. However, the said Bankers Cheques would be subject to realisation.

Parties to the proceedings, who are the petitioners and the respondent filed joint affidavit to put an end to the

long drawn litigation in order to maintain peace and cohesiveness between each other. The said joint affidavit was filed on 24.02.2025 enumerating certain terms and conditions with regard to process of settlement and in doing so, part payments were made on 24.02.2025 and the final payments of Rs.7,00,000/- to petitioner No.2 and Rs.2,00,000/- to petitioner No.1 were scheduled to be made today. Under the circumstances, the condition with regard to payment has been complied as on today.

Both parties have jointly agreed to put an end to the ordeal of the litigation pending for quite sometime before the Court. The terms and conditions are enumerated in the joint affidavit, wherein the parties have agreed to close all the litigations and withdraw all the

cases by compounding and compromising the Criminal Petitions pending before the Courts against the respondent and his family members/relatives, so also, the divorce petition in MC.No.5406/2016 pending on the file of VI Additional Principal Judge, Family Court, Bengaluru.

This Court has enquired with the petitioners and the respondent. They together submit that they have signed and executed this joint affidavit without any force, coercion or pressure from anyone. They have executed this agreement of compromise by way of joint affidavit freely and voluntarily with the deliberate knowledge of putting an end to this litigation and maintain peace and harmony amongst themselves.

Under the circumstances, the joint affidavit is accepted. The parties shall govern themselves in accordance to the terms and conditions stipulated in the joint affidavit. They shall move the concerned Court for compounding and compromising the petitions filed against the respondent for the criminal prosecution. The petitioner

shall file a memo of withdrawal of the petition in Crl.Misc.No.23/2015 filed under the provisions of the Protection of Women from Domestic Violence Act, 2005, so also, both the parties shall file a joint memo/affidavit/ application for mutual consent of divorce. Accordingly, I pass the following:

i) This petition is disposed off in accordance to the terms and conditions of the joint affidavit filed by both the parties;

ii) The parties shall govern by the terms and conditions of the joint affidavit and comply with the terms and conditions stipulated in the joint affidavit by end of April, 2025;

iii) The parties shall make endeavour to comply all

the formalities on or before 29.04.2025;

iv) Ordered accordingly.
