Aggrieved by the order passed in Crl.M.C.No. 69/2023 dated 20.07.2024 by the Principal Judge, Family Court, D.K., Mangaluru, the husband is before this Court.

The Court by order impugned had granted maintenance of an amount of Rs.25,000/- from the date of petition i.e., from 07.08.2023 and also cost of the petition was fixed at Rs.10,000/-. When the matter came up for admission,

this Court had granted stay on the condition that the petitioner shall pay an amount of Rs.15,000/- per month and the arrears also within a period of two months.

Learned counsel appearing for the petitioner submits that he has complied with the order passed by this Court.

No notice is served on the respondent and no vakalath is filed on behalf of the respondent.

Learned counsel appearing for the petitioner submits that the wife is educated. Earlier she was working and getting a salary of Rs.10,000/- p.m. and her husband is a Contractor. She is working along with her father and she has not disclosed any of these aspects and about the income in the statement of assets and liabilities filed before the Court. He submits that she has deserted the husband and she had left the Company. He had to take care of his mother and it is submitted that the Court had granted maintenance of an amount of Rs.25,000/- per month. With regard to the maintenance, she is not at all entitled for maintenance.

Having heard the learned counsel appearing for the petitioner, perused the material on record. Even as per the submission of the Counsel, earlier she was working and earning an amount of Rs.10,000/- and now it is submitted that she is working with the father and earning. What is it that she is earning? Nothing is there on record. As per the record, she is not working. The Court had granted maintenance of an amount

of Rs.25,000/- per month. The petitioner has to take care of his

mother and has submitted that the disputes arose with regard to the mother.

Considering all these aspects, this Court deems it

appropriate to pass the following:

(i) The petition is partly allowed by modifying the order dated 20.07.2024 passed in Crl.M.C.No.69/2023 by the Court of Principal Judge, Family Court, D.K., Mangaluru by reducing the maintenance from an amount of Rs.25,000/- p.m. to an amount of Rs.10,000/- p.m.
