High Court of Karnataka (K. Natarajan, J.), RFA No.2189/2017 c/w RFA No.2190/2017, decided 09.04.2025 — Cross suits between rival claimants to sites in Nagarabhavi village, Bengaluru. Smt. M. Saroja (plaintiff, O.S.No.741/2011) traced title to sites Nos.20 and 29 through a registered sale deed dated 28.01.2005 from Gundappa, supported by khata certificate/extract, tax receipts, encumbrance certificates, sanction plans and revenue records (Ex.P-1 to P-42). Sri P. Thanikachalam (plaintiff, O.S.No.26605/2011) and Smt. Rukmini claimed through Lakkashettappa: sale deed Ex.D-1 dated 15.09.1980 for 1.1 guntas in Sy.No.83 to Perumal Gownder, a GPA dated 14.09.1982, and conveyances by the widow Smt. Kannamma — gift deed Ex.D-2 dated 19.12.2001 (site No.302) and sale deed Ex.D-56 dated 19.12.2001 (Khata No.108, assessment No.88). Held: (i) the plaintiff in O.S.No.741/2011 proved lawful possession and enjoyment; (ii) the plaintiff in O.S.No.26605/2011 failed — Lakkashettappa and his heirs lost in the civil litigation (O.S.No.4772/1988; RFA No.762/1996 allowed Gundappa's appeal; RFA No.102/2003 remanded; final dismissal on 09.04.2009) and in revenue proceedings (RRT No.946/86-87; RA No.7/87-88), so no title flowed to Perumal Gownder or his heirs; the GPA died with its holder and Smt. Kannamma had no right to execute Ex.D-2/Ex.D-56; the defendants' documents disclosed no proper description, site number or identity of the property; a suit for bare injunction is not maintainable where there is a cloud over the defendant's title; (iii) the Trial Court's judgment and decree dated 18.11.2017 (XXIX Addl. City Civil and Sessions Judge, Bangalore) did not call for interference. Both appeals under Sec.96(1) CPC dismissed.
