Placed before us is a joint memo for settlement, filed

today in Court, which is supported by the affidavits of the parties which records terms and conditions of the settlement. An application under Section 13B of the Hindu Marriage Act, 1955¹ has also been filed today in Court, seeking grant of decree of divorce by mutual consent between the parties in view of the aforesaid joint memo for settlement.

The application is signed by both the parties as well as their respective learned counsel and joint affidavit of the parties is also filed along with the aforesaid application. Both the aforesaid application and the joint memo for settlement are accepted on record. The parties are present in Court and have been identified by their respective learned counsel. The parties admit that they have signed the aforesaid joint memo of settlement along with the two affidavits as well as application under Section 13B of the HM Act along with the joint affidavit. They state that there exists no further dispute between the parties in view of the settlement entered into between them today, which has been recorded in the joint memo for settlement.

We have perused the joint memo for settlement and find that the parties have sought to resolve all the disputes between them. In the joint memo of settlement they had also agreed to seek to dissolve their marriage by mutual consent hence the aforesaid application under Section 13B of HM Act has been filed.
