(PER: HON'BLE MR. JUSTICE B M SHYAM PRASAD) The learned counsel for the respondent has filed

a memo enclosing a copy of a Joint Memo filed by the parties in one of the pending proceedings between them. The terms agreed read as under::

5. Both the parties jointly submit that the marriage solemnized between the Petitioner and 1st Respondent on 14-05-1995 at G.K Kalyana Mantapa, 9th Main, 2nd Stage, Banashankari, Bengaluru shall be dissolved in accordance with the judgment dated 26-052020 passed by the Court of VI Addl. Prl. Judge, Family Court, Bangalore. The appeal filed by the Petitioner in M.F.A.No.2596/2021 shall be withdrawn by him by placing this

Joint Memo before the said Hon'ble Division Bench.

6. The Petitioner and the Respondents hereby undertake and declare that they have no claims whatsoever against each other, either by way of past, present or future claims of any nature whatsoever, either in terms of money/alimony or whatsoever nature.

7. The Petitioner and the Respondents hereby specifically undertake not to make any claim, either past, present or future against each other with respect to any of their assets or properties. The Petitioner and the Respondents also undertake not to harass each other in any manner and not to initiate any judicial proceedings against each other.

8. Respondents undertake to withdraw all the proceedings against Petitioner and they have also undertaken to withdraw Crl. Misc No. 124 of 2023 pending on the file of VI Addl. Prl. Judge, Family Court, Bengaluru and Crl. Misc No. 798 of 2023 pending on the file of VI Addl. Prl. Judge, Family Court, Bengaluru, unconditionally in terms of this joint memo. Proceedings in Crl.MC 124/2023 & Crl. Misc No. 798 of 2023 shall be ordered to be closed

by this Hon'ble Court in terms of this Compromise. Respondents undertake not to make any claim whatsoever pursuant to the orders passed in Crl.Misc No.124/2023.

9. This joint memo is filed voluntarily. There is no coercion or undue influence or force whatsoever by anybody in filing this joint memo. There is no collusion between the parties in filing this joint memo.

10. The terms of the joint memo be recorded as part of Orders of this Hon'ble Court.

The learned counsel for the appellant, who does not contest the afore terms submits that the appeal

could be disposed of. Hence, the appeal stands disposed of in terms of the Joint Memo extracted hereinabove.
