"The present CRP No.240/2020 preferred may not survive at this stage in view ownership of property in dispute. Another suit was filed in O.S.No.1154/2016 seeking for partition which is partly allowed, against this suit for partition the petitioner has preferred RFA No.1608/2024 which is pending. The disposal of RFA No.1608/2024 will decide the ownership of the suit property. Hence for the aforesaid reasons this CRP No.240/2020 may kindly be disposed off subject to results of RFA No.1608/2024 in the interest of justice and equity.”
