This petition is filed challenging the order dismissing the application under Section 227 of the Code of Criminal Procedure. Charge sheet is filed against the petitioner alleging that his expenditure is 71% more than what he has earned in his career as an employee from his employment commencing from 04.02.1988.

An application is filed on the premise that the documents produced by the prosecution in the charge sheet and the evidence sought to be led do not substantiate the contention that the accused has earned income disproportionate to his known source of income. The application is opposed by the prosecution. The Trial Court after considering the materials on record has come to the conclusion that case is made out for trial.

This Court has considered the charge sheet and also the contentions raised in the present petition.

It is submitted by the learned counsel for the petitioner that the total income earned by the petitioner so far is Rs.42,15,700/-. The charge sheet is filed on the premise that he has spent Rs.79,24,068/- so far.

Prima facie, this Court does not find any error in the order passed by the Trial Court rejecting the application under Section 227 of the Criminal Procedure Code. The contention raised by the petitioner have to be considered after full fleged trial.
