Criminal Revision Petition (CRL.RP No. 116 of 2025, NC: 2025:KHC:52265) — State of Karnataka by Bengaluru Metropolitan Task Force Police Station, C.I.D., Bengaluru (through the State Public Prosecutor) sought, under S.397 r/w S.401 Cr.P.C. (S.438 r/w S.442 BNSS), setting aside of the order dated 20.07.2023 in Spl.C.C.No.273/2016 passed by the LXXVII Addl. City Civil and Sessions Judge and Special Judge (Prevention of Corruption Act), Bengaluru City, in proceedings against five accused (inter alia BBMP engineers/officials and a contractor: H.N. Prabhakar, M. Prabhu, D. Nagaraj, M. Thyagaraj and M. Basavaraju). Learned counsel submitted that the matter was squarely covered by this Court's decision in Crl.RP.no.975/2024 and connected matters, disposed of on 22.03.2025 with remand to the trial court for consideration of the sanction order given by the State and continuation of proceedings against the accused, and that unserved respondent no.3 had been a represented party in Crl.RP.no.243/2024.
