In this petition, petitioners have sought for the

following reliefs:-

"A. To quash the proceedings registered as CC No. 3973/2019 for offences punishable under Sections 506, 498A and 504 and Sections 3-6, Dowry Prohibition Act, 1961 pending before the Hon'ble I Addl. Chief Judicial Magistrate, Bangalore Rural against Petitioner No. 1.

B. To quash the proceedings registered as CC No. 3973/2019 for offences punishable under

Learned counsel for the petitioners – accused

Nos.1 and 3 and learned counsel for respondent No.2– defacto complainant have filed a Joint Affidavit duly signed by the petitioners, 2^nd respondent and their respective counsel and the same is taken on record.

Petitioners – accused Nos. 1 and 3 and their

counsel and counsel for respondent No.2 are physically present before the Court and they admit the contents of the Joint Affidavit, which reads as under:-

I, Jajjara Bharat Kumar S/o late Kotaiah J aged about 41 years, residing at 103, Virtue Homes, Rajabhavi Road, Vartur, Bangalore- 560087 and I, J. Indramma, W/o. late Kotaiah J, Aged, Major, Residing at No. 1/151, Zarugumalli, prakasham, Andhra Pradesh, 53274, currently at Bangalore, the Petitioners in the above case and I, Sowmya Y D/o YB Markandeyulu aged

about 36 years, residing at B203, Midtwon Rhythm, B Narayanappa Gardens, Whitefield, Bangalore 560066, the Respondent No-2, today at Bangalore, hereby solemnly swear and states as follows:

1. We state that we are the Petitioners and Respondent No. 2, respectively, in the above petition. We are acquainted with the facts of the case and are competent to swear to this affidavit.

2. We state that we have decided to settle all our disputes between us.

¶47

3. We state that the since we have resolved the dispute among our self the case can be closed, and the proceedings in CC No. 3973/2019 arising out of FIR in Cr No 538/2018 of Whitefield Police Station registered by the Respondent for the offence punishable under sections 34, 498A, 504, 506, of Indian Penal Code, 1806 and section 3 & 4 of Dowry Prohibition Act, 1961, pending in the file of the Court of the Learned I Addl. CJM, Bangalore Rural, can be quashed.

4. We state that we have entered into the joint affidavit through our own will without any influence or coercion and after understanding the contents of the joint affidavit.”
