Accused No.1 in Crime No.67/2025 registered by Chandra Layout Police Station, Bengaluru City for offences punishable under Sections 109, 126(2), 324(4), 351(2), 351(3) & 352 R/w 3(5) of BNS, 2023 is before this Court under Section 483 of BNSS, 2023 seeking regular bail.

Heard learned counsel for the parties.

FIR in Crime No.67/2025 was registered by Chandra Layout Police Station, Bengaluru City against the petitioner and two others for the aforesaid offences, based on the first information dated 10.02.2025 received from Sri Imtiyaz Pasha, who is one of the injured victim in the present case. During the course of investigation, the petitioner herein was arrested on 16.03.2025 and subsequently remanded to judicial custody. Bail application filed by the petitioner in Crl.Mis.No.2574/2025 before the Jurisdictional Sessions Court was rejected on 02.04.2025. Therefore, the petitioner is before this Court.

Perusal of the material on record would go to show that, on 08.02.2025 at about 8.30 p.m, when the first informant and his friend Syed Junaid were returning home from their work place in a vehicle, they had stopped their vehicle for the purpose of attending nature call. At that time, accused persons named in the FIR, all of a sudden came there and after abusing the first informant and his friend, accused persons had allegedly assaulted them with a weapon and thereafter left the place.

It is further alleged that on 09.02.2025,

accused No.3 once again made an attempt to assault the first informant with a deadly weapon and on the said date, people who had gathered at the spot had rescued him. In respect of the alleged incident that had taken place on 08.02.2025, the first information is belatedly submitted on 10.02.2025, which is after a delay of more than 48 hours.

The wound certificate of the injured would go to show that, they have suffered only simple injury in the

incident in question and were treated as out patients. The injured have suffered abrasion & contusion injuries as a result of the assault made by the accused persons. The petitioner is in custody in the present case from 16.03.2025 onwards. Major portion of the investigation is completed.

Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail is required to be answered affirmatively.

The petition is allowed.

The petitioner is directed to be enlarged on bail in Crime No.67/2025 registered by Chandra Layout Police Station, Bengaluru City for offences punishable under Sections 109, 126(2), 324(4), 351(2), 351(3) & 352 R/w 3(5) of BNS, 2023, subject to the following conditions:

a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;

¶46

c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

¶47

d) The petitioner shall not involve in similar offences in future;

¶48

e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
