Petitioners are seeking to quash the proceedings arising out of PCR.No.80/2025 on the file of the Court of II Additional Civil Judge and JMFC at Hosakote and registration of FIR in Crime No.56/2025 of Nandagudi Police Station, Bengaluru district.

Private complaint was filed by respondent Nos.2 and 3, which was referred to police for investigation, consequent to which the aforementioned Crime was registered for the offence Punishable under Section 506, 419, 420, 460 and 468 of IPC.

It is alleged that, the complainants/respondent Nos.2 and 3 had borrowed a sum of Rs.1,84,000/- for their family necessitates from petitioner No.1 / accused No.1 for 3% interest. At the time of advancing the loan, accused No.1 obtained the complainant's left thumb

impression on a blank E-stamp paper and with an intention to grab the complainant's property, misused the said blank E-stamp paper by fabricating the sale agreement etc.

Petitioners are accused Nos.1, 3 and 4

respectively. It is submitted by the learned counsel for petitioners that accused No.2 named in the FIR is no more. Petitioners as well as respondent Nos.2 and 3 are present before the Court. They are identified by their respective counsel.

It is submitted that the parties have

compromised the matter by entering into a settlement in O.S.No.317/2022. The matter is said to have been compromised before the Lok-adalath held on 13.09.2025.

Respondent Nos.2 and 3 namely the

complainants submits that they have settled the dispute with the petitioners before the Lok-adalath.

The Hon'ble Apex Court in 'NARINDER SINGH

¶48

AND OTHERS' reported in (2014) 6 SCC 466 has held

¶49

that when the parties have reached the settlement, and on that basis, petition for quashing the criminal proceedings is filed, the guiding factor in such cases would be to: i) secure ends of justice, or ii) to prevent abuse of the process of any Court. Those criminal cases having overwhelming and predominantly civil character, particularly those arising out of commercial transaction or arising out of matrimonial relationship or family dispute should be quashed when parties have resolved their entire dispute among themselves.

The dispute is purely private in nature. The parties have settled the dispute, consequent to which they

have filed the present petition seeking to quash the proceedings.

In the above facts and circumstances, no useful

purpose will be served in continuing the proceedings initiated against the petitioners. Hence, to meet the ends

of justice, it is just and proper to quash the proceedings.

Accordingly, the following:-

i) Petition is allowed .

ii) The entire proceedings in PCR.No.80/2025, on the file of II Additional Civil Judge and JMFC, Hosakote and the FIR in Crime No.56/2025 registered at Nandagudi Police

Station, Bengaluru, are quashed .
