ORAL ORDER

In this petition, the petitioners seeks the following reliefs:

“1. Set aside the order dated 13.03.2020, whereby cognizance was taken and a case was registered in C.C.No.5658/2020 arising out of PCR No.12456/2018 against Petitioners No.1 to 6 for the offences punishable under Sections 406, 420, 107, 120 and 120B of the Indian Penal Code, which is presently pending on the file of the IV ACMM, Bangalore; and

2. Quash the entire proceedings in C.C.No.5658/2020 arising out of PCR No.12456/2018 against the petitioners by allowing this Criminal Petition filed under Section 482 of the Code of Criminal Procedure, pending on the file of the IV ACMM, Bangalore; and

3. Grant such other releif’s as this Hon’ble Court may deem fit and proper in the interest of justice.”

Heard learned counsel for the petitioners and perused the material on record.

Though several contentions have been urged by both sides in support of their respective claims, I deem it just and

appropriate to dispose of this petition by directing the petitioners to urge all contentions before the Trial Court, who shall consider the same in accordance with law. Further, the Trial Court is directed to dispose of the matter, as expeditiously as possible and preferably within a period of six months from the date of receipt of a copy of this order. Subject to the aforesaid observations and directions, the petition stands disposed of.

All rival contentions are kept open and no opinion is expressed on the same.
