Accused No.3 in Crime No.183/2024 registered by Hullahalli Police Station, Mysore, for the offences punishable under Sections 61(1), 103(1), 238, 3(5) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNS') is before this Court under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail.

Heard the learned counsel for the parties.

F.I.R. in Crime No.183/2024 was registered by Hullahalli Police Station, Mysore, initially for the offences punishable under Section 103 of BNS Act 2023 against unknown persons based on the first information dated 18.10.2024 received from Rangaramu A, s/o Anjanaiah elder brother of deceased Sadashiva. During the course of investigation of the case, the petitioner herein was arrested on

03.11.2024 and subsequently remanded to judicial custody.

After completing investigation, charge sheet has been filed against three persons and petitioner herein is arraigned as accused No.3 in the charge sheet.

The bail application filed by the petitioner in Crl.Misc.No.277/2025 before the jurisdictional Sessions Court was rejected on 22.03.2025. Therefore, he is before this Court.

Perusal of material made available on record would

go to show that FIR in the present case was initially registered against unknown persons after the dead body of deceased Sadashiva was recovered. In the charge sheet which is subsequently filed against three persons it is alleged that accused No.1- Rajeshwari had developed illicit relationship with accused No.2 who is the son of elder sister of deceased Sadashiva, husband of accused No.1-Rajeshwari. After accused No.1-Rajeshwari was advised by family members, she allegedly discontinued her relationship with accused No.2 and thereafter developed relationship with accused No.3. Subsequently, accused Nos. 1 to 3 allegedly conspired to commit the murder of Sadashiva and in furtherance of such conspiracy on

17.10.2024 all the accused had mixed sleeping tablets in the

food of deceased and made him consume the same in his house and thereafter when he was sleeping they shifted him in a autorickshaw driven by a accused No.2 and in a isolated place the accused persons made Sadashiva to sleep on the ground and when the accused Nos. 2 and 3 held the deceased, accused No.1 allegedly assaulted Sadashiva on his neck with a knife which she had bought and thereby, accused persons committed his murder.

Allegation in the charge sheet as against accused Nos. 2 and 3 are similar. Accused No.2 is granted regular bail in Crl.P.No.6052/2025, disposed of on 12.06.2025. Accused No.1 has been enlarged on bail by the jurisdictional Sessions Court in Crl.Misc.No.2063/2024 disposed of on 20.03.2025. Undisputedly, petitioner has no criminal antecedents. Under

the circumstances, on the ground of parity , he is entitled for grant of regular bail.

The petitioner is directed to be enlarged on bail in Crime No.183/2024 registered by Hullahalli Police Station, Mysore, for the offences punishable under Sections 61(1), 103(1), 238, 3(5) of the Bharatiya Nagarik Suraksha Sanhita, 2023, subject to the following conditions:

a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;

¶50

c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future;
