Prohibition Act, 1961, are before this Court under Section 482 of BNSS, 2023, seeking anticipatory bail.

Heard the learned counsel for the parties.

FIR in Crime No.7/2025 was registered by Molakalmuru Police Station, Chitradurga, for the aforesaid offences against one Marappareddigari Sudarshanareddy and petitioners herein based on the first information dated 08.01.2025 received from Chalapala Venkataranganayakamma, who is the mother of deceased Pravallika. Apprehending arrest in the case, petitioners who are arraigned as accused Nos.2 to 6 had filed Crl.Misc.No.81/2025 before the jurisdictional Sessions Court which was rejected on 18.02.2025. Therefore, they are before this Court.

A perusal of the material on record would go to show that marriage of accused No.1 with deceased Pravallika was solemnized on 07.12.2023. In the first information, it is stated that from the month of August, 2024, accused No.1 and his wife/deceased were residing separately in a rented premises. Petitioners herein are the in-laws of deceased. The allegation against them are general and omnibus in nature. Undisputedly,

they do not have any criminal antecedents. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioners for grant of anticipatory bail needs to be answered affirmatively. Accordingly, the following order:-

The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.7/2025 registered by Molakalmuru Police Station, Chitradurga, for the offences punishable under Sections 80, 115(2), 352 read with Section 3(5) of BNS, 2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961, subject to the following conditions:

The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/each with two sureties for the likesum to the satisfaction of the investigating officer.

Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.

Petitioners shall not tamper with the prosecution witness and they shall co-operate with the police for investigation and appear before them whenever called upon.

The petitioners shall not involve in similar offences in future.
