Accused in Crime No.307/2024 registered by Periyapatna Police Station, Mysuru District, for the offences punishable under Sections 352 and 109 of BNS, 2023, is before this Court under Section 483 of BNSS, 2023, seeking regular bail.

Heard the learned counsel for the parties.

FIR in Crime No.307/2024 was registered by Periyapatna Police Station, Mysuru District, for the aforesaid offences against the petitioner herein based on the first information dated 01.12.2024 received from Chandregowda, who is the father of victim B C Venkatesha. During the course of investigation, petitioner herein was arrested on 03.12.2024 and subsequently, remanded to judicial custody. Investigation in the case is completed and charge sheet has been filed for the aforesaid offences. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5029/2025 was rejected on 07.02.2025. Therefore, he is before this Court.

A perusal of the material on record would go to show that injured Venkatesha is the brother-in-law of the petitioner herein. Petitioner's younger sister Ramya, is married to injured Venkatesha. In the charge sheet, it is alleged that petitioner was insisting his sister to sign on certain documents relating to immovable property of the family. Venkatesha had opposed the same and he had asked his wife not to sign any such documents. Therefore, petitioner allegedly had ill-will against his brother-in-law Venkatesha and on 01.12.2024 at about 04.50 p.m. when Venkatesh was consuming alcohol in a bar petitioner, who came there abused his brother-in-law Venkatesha and thereafter, allegedly assaulted him with an iron pipe on his head and left the place. Injured Venkatesha was immediately shifted to Hospital at Periyapatna and subsequently, he was shifted to NIMHANS Hospital at Bengaluru since he had suffered head injury. Injured Venkatesha was admitted in NIMHANS Hospital on 02.12.2024 and was discharged from said Hospital on 03.12.2024 and discharge summary of the injured would go to show that injured had not suffered any internal injuries on his head. Petitioner, who has no other criminal antecedents is in custody

from 03.12.2024. Investigation in the case is completed and charge sheet has been filed. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:-

The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.307/2024 registered by Periyapatna Police Station, Mysuru District, for the offences punishable under Sections 352 and 109 of BNS, 2023, subject to the following conditions:

a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;

c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

d) The petitioner shall not involve in similar offences in future;

e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
