Accused No.5 in Crime No.966/2024 registered by

K.R.Puram Police Station, Bengaluru City for the offences punishable under Sections 466, 506, 420, 447, 471, 473, 323 & 441 of IPC is before this Court under Section 482 of BNSS, 2023 seeking anticipatory bail.

Heard the learned counsel appearing for the

parties.

FIR in Crime No.966/2024 was registered by K.R.Puram Police Station, Bengaluru City for the aforesaid

offences after private complaint filed by one Sri Venkatesh G S/o Late Gurumurthappa was referred to the jurisdiction Police by the learned Magistrate. Apprehending arrest in the said case, the petitioner had filed Crl.Misc.No.25050/2025, before the jurisdictional Sessions Court which was rejected on 29.01.2025. Therefore, he is before this Court.

Perusal of the material on record would go to show that, there is a civil litigation between the parties and multiple civil proceedings are initiated between them. The first informant Sri Venkatesh had filed O.S.No.5854/2002 along with other plaintiffs seeking a decree of partition and separate possession and in the said suit, the petitioner herein had examined himself as DW.1. The suit was dismissed on 16.03.2021.

The allegation in the private complaint now filed by the defacto complainant is in respect of the property which is subject matter of the civil dispute between the parties. The alleged offences are triable by the Court of Magistrate and the maximum punishment for the said offences is imprisonment for a period of seven years. Therefore, I am of the opinion that, the petitioner's prayer for grant of anticipatory bail is required to be answered affirmatively.

The Criminal Petition is allowed.

The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.966/2024 registered by K.R.Puram Police Station, Bengaluru City for the offence punishable under Section 466, 506, 420, 447, 471, 473, 323 & 441 of IPC subject to the following conditions:

The petitioner shall appear before

the Investigating Officer in the present case within fifteen days from the date of this order on executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the likesum to the satisfaction of the investigating officer/jurisdictional Court.
