Heard Mr. Srinivas R., learned counsel for the appellant and Mrs. Musrath Tabassum, learned counsel for the respondent.

This Criminal Appeal is filed by the appellant / complainant seeking to set aside the judgment dated 01.08.2022 in Criminal Appeal No.2586/2019 passed by the LXIX Additional City Civil and Sessions Judge (CCH70), Bengaluru, and to convict the accused / respondent by confirming the judgment in C.C.No.4842/2018 dated 14.11.2019 passed by the learned Small Causes Judge (SCCH-9) and XXVI Additional Chief Metropolitan Magistrate, Bengaluru.

Learned counsel for the appellant and the respondent submit that the appellant and the respondent have settled the dispute amicably and filed a Memo on Settlement of even date. The same is taken on record.

The appellant and the respondent are present and are identified by their respective counsels. The Memo on Settlement is duly signed by the appellant, the respondent and their respective counsels. The Memo on Settlement reads thus:

“Both parties i.e., Appellant and Respondent submit as follows:-

The respondent in view of settling the above case amicably on view of the Settlement have now paid Rs.1,50,000/- (Rupees One lakh fifty thousand) to Appellant and Appellant have received the amount.

Wherefore it is prayed to dispose the above appeal as settled in the interest of justice & equity.”

In terms of the averments stated above, the parties have settled the matter amicably and sought to dispose of the matter as per the terms and conditions stated above. Their submission is placed on record.
