Criminal petition under S.528 BNSS, 2023 / S.482 Cr.P.C. by Arvind and Ramesh Chavan seeking quashing of the order dated 27.01.2025 in S.C. No.155/2023 (V Addl. District and Sessions Judge, Kalaburagi) allowing the I.A. under S.319 Cr.P.C. and summoning them as additional accused in Crime No.168/2019 (University P.S., Kalaburagi), registered on the complaint of Sunita W/o Omkar Rathod dated 31.10.2019 under Sections 143, 147, 323, 324, 504, 354, 355, 506 r/w Section 149 IPC. The charge-sheet had dropped the petitioners though they were named in the FIR; during trial the complainant deposed to their individual overt acts, prompting the S.319 application; the Trial Court, following Hardeep Singh v. State of Punjab (2014) 3 SCC 92, summoned and thereafter arraigned them. Held (V. Srishananda J., 4 July 2025): courts considering S.482 relief are not expected to hold a mini trial; the material on record was sufficient to arraign the petitioners and the impugned order required no interference; the Court observed that no sufficient reasons were shown by the Investigating Officer for dropping the petitioners but expressly declined further opinion to avoid prejudicing the trial. Petition dismissed.
