Appellant who is accused No.2, has preferred this appeal

against the order dated 18^th July 2025, passed in Special Case No.9 of 2025 on the file of the II Additional District & Sessions Judge, Kolar (for short "the trial Court").

Brief facts leading to this appeal are that, on the basis of complaint failed by one, Munishami G, Srinivasapura Police have registered case against the accused in Crime No.86 of 2015, for the offences punishable under sections 45, 54, 61, 115(2), 351(2), 352, 103(1) read with section 3(5) of BNS-

2023 and Sections 3(1)(r), 3(1)(s) and 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Appellant/Accused No.2 filed bail application under section 483 of BNSS-2033, which came to be rejected by the trial Court on 18^th July 2025. Being aggrieved by order of rejection of bail appalication, the appellant/accused No.2 has preferred this appeal.

Sri Vivek Subbareddy, learned Senior Counsel appearing for the counsel for the appellant, would submit that a plain reading of complaint reveals that the role of accused No.2 is that he has assaulted on the right leg of the deceased with knife. The investigating officer has recorded further statement of the complainant on 19^th March 2025. In the further statement, it is stated that the time of incident is 7.00 pm. Whereas in the complaint, the time is altered as 8:20 pm and also there is a correction in the word “gÁwæ”. The scribe of the

complaint is not arraigned as witness in the charge-sheet. Further, he would submit that as per the allegation made by the prosecution, the accused has not assaulted to the deceased on

the vital part of his body. The postmortem report reveals that the death is due to shock and haemorrhage as a result of stab injuries caused to abdomen and chest. The deceased not died due to the alleged assault made by accused No.2 below the right knee of the deceased. Now the investigation is already completed accused is not required for any further investigation. Further the bail application filed by accused No.3 in criminal miscellaneous was allowed by the trial Court. The present accused is ready to abide to any of the conditions imposed by this Court. On all these grounds, it is sought to allow the appeal.

As against this, Sri B Lakshman, learned High Court Government Pleader would submit that investigating officer submitted sheet against accused for commission of offences under sections 45, 54, 61, 115(2), 351(2), 352, 103(1) read with section 3(5) of BNS-2023 and Sections 3(1)(r), 3(1)(s) and 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. The alleged offences are punishable with death penalty or imprisonment for life. There are prima-facie materials to attract the alleged commission of offences. Accused 1 and 2, after conspiracy to commit the

murder of the deceased, came to the spot with weapons and committed the murder of the deceased on the spot. CWs2 to 6 are eye-witnesses to the incident. The investigating officer has arrested the accused and on interrogation, investigating officer has recorded their voluntary statement and recovered the weapons used by them for commission of offence under mahazar in presence of panchas.

On the basis of the complaint filed by one Munishami G., Srinivasapura Police have registered case in Crime No.86 of 2025 against accused 1 and 2 for commission of offence punishable under sections 45, 54, 61, 115(2), 351(2), 352, 103(1) read with section 3(5) of BNS-2023 and under sections 3(1)(r), 3(1)(s) and 3(2)(v) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities), Act. After investigation, investigating officer submitted charge-sheet against the accused. In Column No.17 of the charge-sheet, it is stated as under:

A perusal of the charge-sheet, makes it clear that accused No.2 i.e. the appellant herein, has assaulted the deceased Manjunath below right leg, causing bleeding injuries. Injury No.4 reveals " muscle deep incised wound measuring 7 cm into 2 cm is present over inner aspect of upper part of the right leg, placed 10 cm below right knee joint line. Oppression measuring 2 cm into 1 cm is present over front of right knee. " The opinion of the doctor as to the death of the deceased is shock and haemorrhage as a result of stab injuries sustained to abdomen and chest. In the complaint, it is stated that the accused has assaulted on the right leg of the deceased with knife causing bleeding injuries. The statement of witnesses also reveal the same. The present appellant/accused No.2 has not assaulted the deceased on vital part of his body. The specific accusation against accused No.2 is that he has assaulted the deceased with knife below the right leg causing bleeding injuries to the deceased. The main accusation against accused No.1 is that accused No.1 has stabbed the on chest and abdomen. Post-mortem report also reveals that the cause of death is due to stab injuries on abdomen and chest. The accused has not been convicted for any of the offences prior to this alleged

incident. Considering accusation made against the appellant/accused No.2 and also the role of the present accused as alleged by the prosecution as discussed above, and as the accused is not required for any further investigation, I am of the opinion that it is just proper to release the present appellant i.e. accused No.2 on bail with conditions. Accordingly, I proceed to pass the following:

i) Appeal is allowed; Consequently, application filed under section 483 of Code of Criminal Procedure is allowed;

ii) Appellant/accused No.2 shall be released on bail upon executing self-bond for sum of Rs.2,00,000/- with two sureties for the likesum to the satisfaction of the trial Court;

iii) Appellant/accused No.2, shall not tamper or threaten the prosecution witnesses in any manner;
