This petition is filed by accused No.1 under Section 483 of BNSS praying to grant bail in Cr.No.287/2025 of Hoskote Police Station registered for the offence under Sections 115(2), 118(1), 191(2), 189(2), 352, 190, 76 of BNS.

Heard learned counsel for petitioner and learned Additional SPP for respondent/State.

Learned counsel for the petitioner would contend that the petitioner and the injured persons are neighbours and there were quarrels between them and the elders have settled them. Accused No.3 has also filed complaint against the complainant and others and it is registered in Crime No.288/2025. The allegation against the petitioner is assaulting the complainant and outraging her modesty. The petitioner is in judicial custody since 22.10.2025 and

as the major portion of investigation is over, he is not required for custodial interrogation. With this he prayed to allow the petition.

Per contra , learned Additional SPP would contend that all four injured persons have sustained simple injuries. The petitioner has outraged the modesty of the complainant. Investigation is in progress. With this she prayed to reject the petition.

Having heard the learned counsels, the Court has perused the FIR, complaint and other materials placed on record.

As per averments of the complaint, the petitioner and the complainant are neighbourers and there were quarrels between them with regard to silly matters. On the date of incident, the petitioner and other accused persons have quarreled with the injured and her family members. In the said quarrel, the complainant and other three persons sustained simple injuries. Accused No.3 has

also filed a complaint and it is registered in Crime No.288/2025. Therefore, there is a case and a counter case. Who is the aggressor is required to be ascertained after investigation and at trial. The petitioner is in judicial custody since 22.10.2025 and as major portion of investigation is over, the petitioner is not required for custodial interrogation. The petitioner is not having any criminal antecedents. Considering the above aspects, the petitioner has made out case for grant of bail with conditions. In the result, the following:

The petition is allowed. The petitioner is granted bail in Crime No. 287/2025 of Hoskote Police Station, subject to following conditions:

(i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the jurisdictional Court.
