This petition is filed by accused No.3 under Section 483 of Bharatiya Nagrika Suraksha Sanhita, 2023,praying

to grant bail in Special Case No.85/2025 (Crime No.70/2025 of Manipal Police Station), pending on the file of Principal District and Sessions Judge, Udupi District, registered for offences punishable under Sections 8(c), 20(b) and 22(b) of Narcotic Drugs and Psychotropic Substances Act.

Heard learned counsel for petitioner and learned Additional State Public Prosecutor for respondent - State.

No.70/2025 has been granted bail by this Court in Criminal Petition No.9033/2025 by Order dated 07.07.2025. Thereafter, the petitioner has been released on 22.07.2025 by the trial Court. Thereafter, the petitioner

remained absent from 13.08.2025 and he has been secured by executing NBW against him on 09.10.2025. The petitioner has violated the bail conditions. The petitioner has now deposited Rs.25,000/- towards forfeited bond amount of Rs.50,000/- before the trial Court in Special Case No.85/2025. The said amount deposited by the petitioner shall be forfeited to the State towards forfeited bond amount. The petitioner has undertaken to appear before the trial Court on all dates of hearing unless exempted by the trial Court.

Considering all the above aspects, the petitioner

has made out a case for grant of bail with conditions. In the result, the following;

The Criminal Petition is allowed . The petitioner is granted bail in Special Case No.85/2025 (Crime No.70/2025 of Manipal Police Station), pending on the file of Principal District and Sessions Judge, Udupi District, subject to following conditions:

i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the like-sum to the satisfaction of the trial Court.

ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly.

¶40

iii) The petitioner shall appear before the trial Court on all dates of hearing unless exempted by the Court and cooperate for speedy disposal of the case.
