This petition is filed by the sole accused under Section 483 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying to grant bail in Crime No.193/2025 of Mico Layout Police Station, registered for offences punishable under Sections 64(1), 74 and 75(1) of Bharatiya Nyaya Sanhita, 2023, pending in C.C.No.31512/2025 on the file of Chief Judicial Magistrate, Bengaluru.

Learned counsel for petitioner would contend

that, the petitioner is a P.G. owner wherein the victim is inmate of the said P.G. There was a theft of rings and the petitioner found that, the victim has committed theft of the rings. At the time of enquiry, the victim has admitted she having committed theft of the rings. In order to escape from the said liability, the victim has filed a false complaint against the petitioner. There are contradictions in the statement of the victim and in averments of the complaint. The doctor who examined the victim has not given any final opinion. The petitioner is in judicial custody since 23.06.2025 and as the charge sheet is filed, he is not required for custodial interrogation. With these, he prayed to allow the petition.

Per contra, learned Additional State Public Prosecutor for respondent would contend that, C.W.2 to C.W.7 and C.W.17 to C.W.19 are inmates of the P.G. run by the petitioner and if he is granted bail, there is a threat to the said witnesses. The petitioner is a resident of Nellur.

The charge sheet materials show that, there is a primafacie case against the petitioner for offences alleged against him. There are no contradictions in the statement of the victim and in her complaint. With these, she prayed for dismissal of the petition.

Having heard the learned counsels appearing for parties, the Court has perused the charge sheet and other materials placed on record.

The statement of the victim has been recorded on 23.06.2025, wherein she has admitted of she committing theft of the gold rings and there was enquiry in that regard by the petitioner who is owner of the said P.G. The other P.G. inmates were also present at the time of the said enquiry by the petitioner with the victim. The incident has taken place on 21.06.2025 and the complaint has been filed by the victim on 23.06.2025. The victim has been examined by the doctor and the doctor has not given any final opinion, and Sl.No.25 of the said report is kept

blank. Learned counsel for petitioner has pointed out contradictions in the averments of the complaint and in the further statement of the victim recorded by the Police and in the statement recorded under Section 183 of BNSS.

Considering the above aspects, the submission of the learned counsel for petitioner that, a false complaint has been made by the victim against the petitioner cannot be ruled out. The petitioner is in judicial custody since 23.06.2025 and as the charge sheet is filed, the petitioner is not required for custodial interrogation. There are no criminal antecedents of the petitioner. The apprehension of threat by the petitioner on the victim and other prosecution witnesses can be met with by imposing stringent conditions.

7. Considering all the above aspects, the petitioner

has made out a case for grant of bail with conditions. In the result, the following;

The Criminal Petition is allowed . The petitioner is

¶47

granted bail in C.C.No.31512/2025 (Crime No.193/2025 of Mico Layout Police Station) pending in on the file of Chief Judicial Magistrate, Bengaluru, subject to following conditions:

i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the like-sum to the satisfaction of the jurisdictional Court.

ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly.

¶50

iii) The petitioner shall appear before the trial Court on all dates of hearing unless exempted by the Court and cooperate for speedy disposal of the case.

iv) If the petitioner is found threatening the victim and prosecution witnesses, the
