This petition is filed by accused No.1 under Section 483 of Bharathiya Nyaya Suraksha Sanhitha, 2023 praying to grant bail in Crime No.200/2025 of Suddaguntapalya Police Station registered for the offences punishable under

Section 80(2) of Bharathiya Nyaya Sanhita, 2023 and Sections 3 and 4 of Dowry Prohibition Act, 1961.

Heard the learned counsel for petitioner and learned High Court Government Pleader for

respondent/State.

The learned counsel for petitioner would contend that, the petitioner and the deceased were working as software engineers at Bangalore, and residing

in a rented house. After birth of a child, the deceased left her job at INFOSYS, and was taking care of the child. The petitioner has purchased a house and taken housing loan. There was no any complaint earlier by the deceased against this petitioner for harassing and demanding dowry. There is no death note left by the deceased. The petitioner is in judicial custody since 28.08.2025. If he is not granted bail, there are chances of he losing his job. He has to look after his child aged two years. There was a minor dispute between the petitioner and the deceased with regard to going to a native place for Ganesha festival, and the deceased refused to accompany the petitioner to their native place, and with that quarrel, the deceased has committed suicide. With this, she prayed to allow the petition.

Per contra, the learned High Court Government Pleader would contend that, the averments of the complaint, and the statement of witnesses indicate that, the petitioner had demanded dowry and received a sum of

Rs.Five lakh, and was harassing the deceased, due to which, the deceased committed suicide. The offence alleged against the petitioner is a heinous offence punishable with imprisonment for more than seven years, which may extend to imprisonment for life. With this, he prayed to dismiss the petition.

Having heard the learned counsel, the Court has perused the charge sheet and other materials placed on record.

The marriage of the petitioner and the deceased had taken place on 05.12.2022. The petitioner and the deceased were residing in a rented house at Bangalore. It is alleged that, the petitioner was harassing the deceased, demanding to bring money from her parents, and due to which, the deceased has committed suicide. The petitioner had purchased a house by availing housing loan. There were no complaints by the deceased against the petitioner prior to she committing suicide. There is no death note left by the deceased. The petitioner is working as a software

engineer at Bangalore, and if he is not granted bail, there are chances of losing job. The petitioner has to take care of his two years' son. There are no criminal antecedents of the petitioner. He has undertaken to appear before the Trial Court on all dates of hearing, and abide by conditions to be imposed by this Court.

Considering the above aspects, the petitioner

has made out a case for grant of bail with conditions.

i) The petition is allowed.

ii) The petitioner is granted bail in Crime No.200 of 2025 of Suddaguntepalya Police Station registered for the offences punishable under Section 80(2) of Bharathiya

Nyaya Sanhita, 2023 and Sections 3 and 4 of Dowry Prohibition Act, 1961 subject to following conditions:

a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety
