ORAL ORDER

This petition is filed by the sole accused under Section 483 of BNSS praying to grant bail in Crime No.223/2025 of Bannerghatta Police Station registered for offences punishable under Sections 115(2), 126(2), 324(3), 109(1), 351(3), 351(2) of BNS.

Heard learned counsel for the petitioner and

learned Additional SPP for the respondent -State.

Learned counsel for the petitioner would contend that the injured has not sustained any injuries. The only allegation is threatening to kill him with glass piece. The investigation is over and charge sheet has been filed. Therefore, the petitioner is not required for further custodial interrogation. With this, he prayed to allow the petition.

Per contra , Additional SPP for the respondent –

State would contend that there is one eyewitness to the incident. The petitioner has threatened the injured to kill him with broken glass piece. The offence alleged against the petitioner is heinous offence. With this, she prayed to reject the petition.

Having heard learned counsels, the Court has perused FIR, complaint, charge sheet and other materials placed on record.

As per charge sheet, the case of the

prosecution is that the petitioner went to the shop of C.W.1 and purchased 02 cups of tea and a pack of cigarette and when he further asked to give two packs of cigarette, at that time the C.W.1 demanded payment of money and at that time the petitioner has abused him, broken showcase glass and threatened him to kill him with a glass piece. At that time C.W.2 came there and the petitioner also threatened him by showing glass piece. Considering the above aspects there is no any injury to

C.W.1 and C.W.2. The investigation is over and charge

sheet has been filed. The petitioner is in judicial custody since 04.08.2025 and therefore, he is not required for any more custodial interrogation. Considering the above aspects, the petitioner has made out case for grant of bail with conditions.

In the result, the following ORDER

i) The petition is allowed.

ii) The petitioner is granted bail in Crime No.223/2025 of Bannerghatta Police Station subject to following conditions.

a) The petitioner -accused shall execute a personal bond for sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the jurisdictional Court.

b) The petitioner -accused shall not tamper the prosecution witnesses either directly or indirectly.

c) The petitioner -accused shall attend the trial

Court on all dates of hearing unless exempted

and co-operate for speedy disposal of the case.
