NDPS bail refused. Petition under Section 483 BNSS by the sole accused for regular bail in Crime No.109/2025 of Kapu Police Station, registered for offences under Sections 8(c), 20(b)(ii)A and 22(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 and pending before the Principal District and Sessions Judge, Udupi, was dismissed by the High Court of Karnataka (Justice Shivashankar Amarannavar, 13 November 2025). On personal search, two Rs.500/- currency notes were found on the petitioner along with a bag containing two mobile phones, ten small plastic covers of ganja weighing 58.77 grams and a pouch of five blue coloured tablets which the petitioner stated were MDMA; the FSL report found the 58.77 grams positive for ganja and the tablets positive for MDMA. The offence is punishable with imprisonment up to ten years and fine up to Rs.1,00,000/-. Despite contentions of intermediate quantity, conduct of search before a Gazetted Officer (Section 50 NDPS Act) and reliance on a co-ordinate Bench order (Shaik Mohammed Hujeef, Crl.P No.3506/2024), and noting an earlier case against the petitioner (Crime No.118/2018, Bangalore North Police Station, Sections 452 and 34 IPC), the ongoing investigation and the chances of his committing similar offences if released, the Court held that no grounds for bail were made out and dismissed the petition.
