This petition is filed by accused No.6 under Section 483 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying to grant bail in Crime No.231/2025 of Bannerghatta Police Station registered for offences punishable under Sections 109(1), 118(1), 351(2), 351(3), 352, 190 and Section 3(5) of Bharatiya Nyaya Sanhita, 2023.

Heard the learned counsel for petitioner and

learned Additional State Public Prosecutor for respondent - State.

Learned counsel for petitioner would contend that, accused Nos.2, 4 and 5 were similarly placed with that of this petitioner have been granted bail by this Court in Criminal Petition No.13051/2025 vide order dated 25.09.2025 and therefore, the petitioner is entitled for grant of bail on the ground of parity. He further submits that, the injured has taken treatment as out patient and he has sustained only simple injuries. The petitioner is ready to cooperate with the police in investigation. With these, he prayed to allow the petition.

Per contra, learned Additional State Public Prosecutor would contend that, the investigation is in progress. Hence, she prayed for dismissal of the petition.

Having heard the learned counsels appearing for the parties, the Court has perused, FIR, complaint and other materials placed on record.

In the complaint lodged by one Ravikumar, he has alleged that on 08.08.2025 at about 8.10 p.m., when

he was near one Anshika Bar and Restaurant, Jangalpalya Gate, Jigani, Anekal Taluk, accused Nos.1 and 2 along with others came and abused him and assaulted on his head with beer bottles and while trying to avoid the said assault, he sustained injuries to his right hand. Thereafter, the said accused went away threatening him with dire consequences etc. In the remand application, the petitioner has been arrayed as accused No.6 and there are eight accused persons in the remand application. The name of the petitioner and accused Nos.2, 4 and 5 are not mentioned in the FIR. The specific allegations of assault are against Sri.Harish and Sri.Rakesha whose names are found in the FIR as accused Nos.1 and 2. In the remand application, omnibus allegations are made that other accused have also assaulted the complainant. The petitioner has already been arrested and interrogated. As per wound certificate, victim has sustained three simple injuries. The petitioner has undertaken to cooperate with

the police in further investigation and abide by any terms and conditions to be imposed by this court.

Considering all the above aspects, the petitioner

has made out a case for grant of bail with conditions. In the result, I pass the following:

ORDER

This Criminal Petition is allowed . The

petitioner/accused No.6 is granted bail in Crime No.231/2025 of Bannerghatta Police Station, subject to following conditions:

¶44

i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the likesum to the satisfaction of the Jurisdictional Court.

ii) The petitioner shall cooperate with the Police in investigation.

¶46

iii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly.

iv) The petitioner shall appear before the Trial Court on all the dates of hearing unless exempted by the Court and cooperate for the speedy disposal of the case.

v) The petitioner shall not commit any offence. The prosecution is at liberty to move for cancellation of bail if petitioner is found involved in any case.
