This petition is filed by accused Nos.1 to 5, 7 to 10 under Section 482 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying to grant anticipatory bail in Crime No.233/2025 of Tumakuru Rural Police Station, registered for offences punishable under Sections 189(2), 191(2), 351(2), 352, 115(2), 118, 109 and 190 of Bharatiya Nyaya Sanhita, 2023.

Heard learned Counsel for petitioners and learned High Court Government Pleader for respondent No.1 - State. Notice issued to respondent No.2 is returned with an endorsement as 'refused'.

Learned counsel for petitioners would contend

that, there was a quarrel between the petitioners and the victims. There was earlier quarrel between accused No.1

and the first informant. In the quarrel, nobody has sustained any injuries. Accused No.10 who is petitioner No.9 has also filed complaint and it came to be registered in Crime No.234/2025 with regard to the same incident dated 09.09.2025 taken place at 07.30 p.m. There is a case and a counter case. The petitioners are ready to cooperate with the police in investigation and abide by any terms and conditions to be imposed by this Court. The petitioners are not having any criminal antecedents. With these, he prayed to allow the petition.

Per contra, learned High Court Government Pleader for respondent No.1 would contend that, out of the incident, two complaints have been filed and considering the same, there is a case and counter case. The petitioners and the victims are absconding. There is no any wound certificate of the victims. With these, she prayed for dismissal of the petition.

Having heard the learned counsels appearing

for the parties, the Court has perused the FIR, compliant and other materials placed on record.

There was enmity between accused No.1 and the first informant with regard to quarrel took place during Hatti Maramma Jathra. With regard to the said enmity, there was a quarrel on 09.09.2025 between first informant and accused persons. In the said incident, it is stated that petitioners assaulted the victim and others and the victim and others have assaulted the petitioners. There is a complaint by accused No.10 registered in Crime No.234/2025. Considering the same, there is a case and a counter case. Even though there is an alleged assault by weapon, as the victims are absconding in the counter claim, there is no wound certificate. The petitioners are ready to cooperate with the police in investigation and abide by any terms and conditions to be imposed by this Court. There are no criminal antecedents of the petitioners.

Considering the above aspects, the petitioners

have made out a case for grant of anticipatory bail with conditions. In the result, the following;

ORDER

The Criminal Petition is allowed . The petitioners are granted anticipatory bail in Crime No.233/2025 of Tumakuru Rural Police Station and are ordered to be released on bail in the event their arrest, subject to following conditions:

i) The petitioners shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each with one surety for the likesum to the satisfaction of the Investigating Officer.

¶60

ii) The petitioners shall voluntarily appear before the Investigating Officer within 10 days from this day and execute bail bond and furnish surety.
