This petition is filed under Section 482 of BNSS seeking grant of anticipatory bail in respect of Crime No.138/2025 of Nelamangala Town Police Station registered for the offence punishable under Section 108, 75, 78 of BNS, 2023.

Heard learned counsel for the petitioner and learned HCGP for respondent / State.

Learned counsel for the petitioner would contend that petitioner is a married man and his marriage has taken place in the year 2019 and has a child. Petitioner had transferred money through Phonepe to the account of the deceased and except that there is no transaction

between petitioner and the deceased. Petitioner earlier also had attempted to commit suicide. Petitioner is ready to co-operate with the police in investigation and abide by terms and conditions to be imposed by this Court. With this, he prayed to allow the petition.

Per contra, learned HCGP would contend that the averments of the complaint indicate that the petitioner has harassed the deceased by breaking her marriage and due to the said abatement she committed suicide. The case is under investigation and therefore, at this stage, petitioner is not entitled for grant of anticipatory bail. With this, he prayed for rejection of the petition.

Having heard the learned counsels, this Court has perused the FIR, complaint and other materials placed on record.

The accusation against the petitioner as per the complaint is that he had contact with the deceased and he was insisting her to love and marry him and had behaved

indecently with her, due to which, she earlier had attempted to commit suicide on 05.07.2025. Thereafter the marriage of the deceased was fixed with one Ranjith and this petitioner is stated to have made a phone call to the said Ranjith and broke that marriage, due to which, the deceased committed suicide. Whether this petitioner has abated the deceased to commit suicide is a matter of investigation and trial. The offence alleged against the petitioner is not punishable with death or imprisonment for life. Petitioner has undertaken to abide by conditions to be imposed by this Court. Petitioner has made out a case for grant of anticipatory bail with conditions. In the result, the following:

event of his arrest in Crime No.138/2025 of Nelamangala Town Police Station, subject to following conditions:

(i) Petitioner shall execute a personal bond in a sum of Rs.1,00,000/- (Rupees one lakh only) with one surety for the like-sum to the satisfaction of the investigating officer and shall appear before the investigating officer within 15 days from this day and execute bail bond and furnish surety.
