This petition is filed by sole accused under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, praying to grant bail in Crime No.200 of 2025 of Indiranagara Police Station registered for the offences punishable under Sections 109, 352 of Bharatiya Nyaya Sanhita, 2023.

Heard the learned counsel for petitioner and the learned Additional State Public Prosecutor for respondent/ State.

The learned counsel for petitioner would

contend that, FIR came to be registered against the unknown persons. The injuries stated to have been sustained by the injured is stated to be non-grievous injury. The investigation is almost completed, and charge sheet is yet to be filed. The petitioner is in judicial custody since 19.08.2025, and therefore, he is not required for custodial interrogation. With this, he prayed to allow the petition.

Per contra, the learned Additional State Public Prosecutor would contend that, the petitioner has used a deadly weapon i.e. knife, and assaulted on the vital part of the injured i.e. abdomen, and there is a cut lacerated wound measuring 4 cms. on the left medial aspect of abdomen with active bleeding. The very fact of the petitioner bringing knife and assaulting on the abdomen of the injured indicates that, he is having an intention to kill him. There are two eyewitnesses to the incident whose statements are already recorded. The investigation is still

in progress. The knife, which is stated to have been used by the accused, has been recovered at his instance. If the petitioner is granted bail, there are chances of he hampering the investigation and tampering the prosecution witnesses and committing similar offences. With this, she prayed for dismissal of the petition.

Having heard learned counsel, the Court has perused the FIR, complaint and other materials placed on record.

Upon the first information of one Andrew E, case came to be registered against unknown persons in Crime No.200 of 2025 of Indiranagar Police Station for the aforesaid offences.

On perusal of the averment of the first information, it is stated that the petitioner quarrelled with the injured, and when the same is questioned by the injured, the petitioner went and brought a knife and

assaulted with the knife on the stomach of the injured and caused bleeding injury.

On perusal of the wound certificate, the injured sustained cut lacerated wound measuring 4 cms. on the left medial aspect of abdomen with active bleeding. Even though it is stated to be non-grievous, on considering the part on which it is caused i.e., abdomen, the intention of the petitioner is clear that, it is made with an intention to commit murder of the injured.

The incident has been witnessed by two persons whose statements are already recorded. The knife is stated to have been used by the petitioner and has been recovered at his instance.
