This petition is filed by the petitioner - accused No.6

under Section 482 of Bharatiya Nagrika Suraksha Sanhita seeking grant of anticipatory bail in Crime No.162/2025 of Chamarajanagar Rural Police Station registered for offence punishable under Section 108 of Bharatiya Nyaya Sanhita, 2023.

mentioned in the complaint and FIR and his name came to be inserted by way of requisition dated 19.08.2025 on the basis of a letter of the first informant dated 18.08.2025. He further submitted that, the said letter of the first informant is based on statement of one Sri. Subramanya, S/o. Nagaraju. He further submitted that, considering all the materials on record, it is seen that there is no abetment by the petitioner to the deceased to commit suicide. He further submitted that, non payment of amount borrowed does not amount to abetment to commit suicide by the lender. He also submitted that, the petitioner is ready to co-operate with the police for investigation. With these, he prayed to allow this petition.

Learned Additional Special Public Prosecutor for respondent – State would contend that, one Sri. Subramanya has seen the petitioner talking with the deceased in a loud voice and he was refusing to repay the amount borrowed. Due to the said act of the petitioner and others, the deceased committed suicide. This case is

under investigation and the petitioner is required for custodial interrogation. With these, she prayed for dismissal of the petition.

Having heard the learned counsels appearing for the parties, this Court has perused the complaint, FIR and other materials placed on record.

Case came to be registered in Crime No.162/2025 in Charmarajanagar Rural Police Station against accused Nos.1 to 5 for offences punishable under Section 108 of Bharatiya Nyaya Sanhita on the first information of one - Sri. Chandra S/o. late Nagaraju who is the son of deceased - Smt. Meenamma.

On perusal of the first information filed by said Sri. Chandra S/o. Late Nagaraju, it is seen that the name of the petitioner is not mentioned in it. In the first information, there is allegation of abetment to commit suicide against accused Nos.1 to 5 who are said to have refused to repay the amount borrowed from the deceased

and because of the abetment, she committed suicide. The petitioner has been implicated on the requisition dated 19.08.2025 filed on the basis of a letter dated 18.08.2025 given by the first informant to the police. In the said letter, the first informant has mentioned that, one Sri. Subramanya S/o. Late Nagaraju met him on 17.08.2025 and told that, on 13.08.2025 at about 10.30 a.m. his deceased mother - Smt. Meenamma was talking with the petitioner and petitioner had in loud voice told his mother that, he will not repay the amount borrowed. Whether non-payment of amount borrowed would amount to abetment to commit suicide of the lender is a matter of trial. The offence alleged against the petitioner is not punishable either with death or imprisonment for life. The petitioner has undertaken to co-operate with the police for investigation.

made out a case of grant of anticipatory bail with conditions. Hence, the following:

This Criminal Petition is allowed . The petitioner is granted anticipatory bail in Crime No.162/2025 of

Chamarajanagar Rural Police Station and is ordered to be released on bail in the event his arrest, subject to following conditions:

i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the likesum to the satisfaction of the Investigating Officer.
