Petitioner arraigned as accused No.8 in

Cr.No.143/2025 of Mangalore South Police Station, Mangaluru City, registered for the offence punishable under Section 8(c) and 22(C) of NDPS Act, 1985, has preferred this petition under Section 483 of BNSS, to enlarge him on bail.

In a suo moto complaint lodged by the police attached to Mangalore South Police Station, Mangaluru City, it is alleged that on a credible information received on 14.7.2025 at about 9.00 a.m. that accused by name Rahul, Sangeeth Krishna and others have procured MDMA and they are attempting to sell it to the public near Bhagat Singh road, Mangaluru, the police went to the spot, along with panchas and noticed about nine persons in 2 cars and

2 two wheelers. On seeing the police, one of the accused

escaped, whereas, rest of the accused were apprehended.

FIR is registered against accused Nos.1 and 2 and others. Petitioner is arraigned as accused No.8 in the remand application. It is alleged that 5.80 grams, 4.24 grams, 2.31 grams of MDMA, 3 small plastic covers etc., were recovered from accused No.1-Rahul and 7.78 grams, 2.00 grams and 2.07 grams of MDMA and 3 small plastic covers etc., were recovered from accused No.2-Sangeeth Krishna.

Admittedly, there is no recovery of any contraband from the petitioner, as per remand application. According to prosecution, since the petitioner was along with accused Nos.1 and 2, he is also involved in the offence. Merely because the petitioner was present along with accused Nos.1 and 2, that itself is not a ground to deny the relief sought in the petition. At this stage, there are reasonable grounds to believe that petitioner is not guilty of the offence. Petitioner is aged about 19 years.

He is said to be a student pursuing his Bachelor of Physiotherapy, in Srinivas University, Mangaluru. His examination is said to be scheduled from 12.9.2025. Learned counsel for the petitioner has produced the admission ticket of the petitioner.

In the above facts and circumstances, imposing

necessary conditions, petitioner can be admitted to bail. Hence, the following:

I. Petition is allowed.

II. Petitioner/accused No.8 in Crime No.143/2025 of Mangaluru South Police Station, Mangaluru, shall be enlarged on bail, subject to following conditions:

He shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only), with two sureties for the likesum to the satisfaction of the jurisdictional Court.
