THIS CRIMINAL PETITION IS FILED UNDER SECTION 482 OF THE CRIMINAL PROCEDURE CODE, 1973 (UNDER SECTION 528 OF BHARATIYA NAGARIK SURAKSHA SANHITA, 2023) PRAYING TO QUASH THE ENTIRE PROCEEDINGS IN C.C.NO.3546/2025, WHICH IS PENDING ON THE FILE OF ADDITIONAL CIVIL JUDGE AND JMFC, RAIBAG, ARISING OUT OF CRIME NO.35/2024, WHICH IS REGISTERED BY HARUGERI POLICE, FOR THE OFFENCES PUNISHABLE UNDER SECTIONS 323, 324, 504, 506 READ WITH SECTION 34 OF IPC, IN RESPECT OF THE PETITIONERS/ACCUSED NOS.1 TO 4 HEREIN, IN THE INTEREST OF JUSTICE.

Learned counsels for both the parties have filed a joint application for compounding the offence under Section 359 read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023. The averments of the said application at paragraphs Nos.3 to 6 read as under:

“3. That during the pendency of these proceedings the Respondent No.2 and victims and Petitioners have amicably settled the matter. Now, the Respondent No.2 and Victim No.01 and 02 hereby withdraw all the allegations made against Petitioners and have no objection to quash the entire proceedings in C.C No.3546/2025 which is pending on the file before The Hon'ble PRL. C J, JMFC, Raibag arising out of complaint, FIR in Crime No.0035/2024, Chargesheet No.155/2025 for the offences punishable under sections 323, 324, 504, 506 R/w 34 of IPC the Petitioners and the Respondent No.2 and

victim No.01 and 02 has undertaken to put an end to this case.

4. It is submitted that Respondent No.2 and victim No.01 and 02 first informant is not interested prosecute the case against the Petitioners, Hence all the parties are voluntarily ready to end the disputes.

5. It is submitted that if this application is allowed, no loss or harm will be caused to Respondent No. 01. If the same denied, the parties will face untold hardship and injury which cannot be compensated in terms of money.

6. The Accused No. 01 to 04/Petitioners and Respondent No.02 and victim No.01 and 02 request leave to urge such other grounds as would be available at the time of hearing of the above petition.”

Considering the nature of offence and gravity

thereof, it is appropriate to allow the application.

Accordingly the application is allowed.

In the result, the petition is allowed.
