Heard Smt. Akshatha, appearing on behalf of Sri Suraj S Mutnal, counsel for the petitioner and Smt. Girija Hiremath, learned High Court Government Pleader for the respondent.

This Court by considered order dated 26.04.2025 granted anticipatory bail to the petitioner. This Court imposed as many as nine conditions of which the relevant condition which is now sought to be modified is condition No.6 which reads as under:

“Petitioner shall co-operate with the Investigating Agency even after he is enlarged on bail by marking his attendance before the Investigating Officer on every third Sunday between 10.00 am and 2.00 pm till the final report is filed.”

It is contended on behalf of the petitioner that the

petitioner is physically challenged person and he is unable to comply the condition No.6.

The condition No.6 incorporated by this Court in the

order dated 26.04.2025 would be requisite for the proper investigation and also to monitor the activities of the petitioner. Once in a month that too on third Sunday between 10.00 am to

2.00 pm the petitioner is required to mark his attendance before the Investigating Officer at Belagavi.

The offences alleged are serious in nature including the offences under Sections 66 (C) and 66 (D) of the Information Technology Act, 2008.

Taking note of the same, the condition No.6 is a requisite condition to harmonize the right of the petitioner and need of the prosecution which requires no modification.
