Learned counsel for the petitioners filed a compromise petition under Section 320 of Cr.P.C. (Section 359 of BNSS), stating that the matter has been settled between the petitioners and the respondent.

The averments of the said compromise petition from paragraph Nos.1 to 5 are reads as under:

“ 1. The Petitioners and the respondent no.2/Complainant herein on the advice of the well wishers and elderly persons have mutually agreed to amicably settle the matter between them on the following terms and conditions;

2. The above petition is filed by Petitioners/accused no.1 to 5 seeking for quashing the charge sheet and entire proceedings in C C no. 4231/2024 pending on the file of the Court of Prl. Civil Judge & JMFC Court, Raibag, as against present Petrs/Accused no.1 to 5 are concerned for the alleged offence punishable under sections 189(2), 191(2),

The Respondent no.2/Complainant is now residing with her husband and in-laws happily in her matrimonial home, hence the respondent no.2/Complainant has decided to not to proceed with the case and further has no objection to quash the entire proceedings in C.C no.4231/2024 pending on the file of Principal Civil Judge & JMFC Court, Raibag (arising out of Crime no.209/2024) for the offence punishable u/s 189(2), 191(2), 115(2), 85, 353, 351(2) R/W Section 190 of BNS 2023.

4. The Respondent no.2/Complainant has also consented to forget all the differences and disputes arose between each other and have agreed to lead happy life with all the members of the family to uphold the basic concept of betterment of family in the society.

5. The Petitioners/accused no.1 to 5 and respondent no.2/Complainant undertakes that, they are ready to obey and follow the above said terms and conditions imposed upon them through this compromise petition.”
