Accused Nos.3 and 4 in Crime No.88/2025 registered by Halebeedu Police Station, Hassan for the offences punishable under Sections 109, 115(2), 121, 126(2), 189(2), 190, 352 of BNS, 2023 are before this Court under 482 of BNSS, 2023, seeking anticipatory bail.

Heard the learned counsel for the parties.

FIR in Crime No.88/2025 was registered by

Halebeedu Police Station, Hassan for the aforesaid offences against Nethra and others based on the first information dated 24.05.2025 received from Ranganatha S/o. Marigowda, who is

the injured victim in the present case. Apprehending arrest in the said case, the petitioners had filed Crl.Misc.No.537/2025

before the jurisdictional Sessions Court, which was rejected on

17.06.2025. Therefore, they are before this Court.

Perusal of the material on record would go to show

¶37

that name of the petitioners is not found in the FIR. FIR has been registered against Nethra, Chethan and unknown persons. Accused Nos.1 and 2, who were arrested in the present case,

are said to have been granted regular bail by the jurisdictional Court. Petitioners, aged about 21 years and 22 years respectively have no other criminal antecedents.

Learned HCGP fairly submits that first informant has suffered only simple injuries in the incident in question.

Petitioners have undertaken to co-operate with the police for the purpose of investigation. Therefore, I am of the opinion that prayer made by the petitioners for grant of anticipatory bail is required to be answered in the affirmative. Accordingly, the following:

The petition is allowed. The respondent-Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.88/2025

of Halebeedu Police Station, Hassan for the offences punishable under Sections 109, 115(2), 121, 126(2), 189(2), 190, 352 of BNS, 2023, subject to the following conditions:

The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties each for the likesum to the satisfaction of the investigating officer.

Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.

¶49

Petitioners shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon.

¶50

The petitioners shall not involve in similar offences in future.
