The petitioner/accused No.1 in Crime No.318/2025 of Kunigal Police Station is seeking to quash the entire proceedings therein, on the ground that the said case registered against him and two others is nothing but a counter blast to the case registered against the husband of the first informant/respondent No.2 herein and two others, in Crime No.317/2025.

This Court finds that there is a case registered

at the first instance on 09.07.2025 at about 12:30 P.M, on

a complainant lodged by one Lakshman Naik, none other than the petitioner's father. The said case was registered against accused Nos.1 to 3, wherein accused No.2 is the husband of respondent No.2.

It is the contention of the learned counsel for

the petitioner that after the registration of the above case, respondent No.2 herein has come up with a false complaint against the petitioner and others and the present case is registered against them in respect of the incidents took place between 25.06.2025 and 08.07.2025.

Both the parties are making allegations against each other, particularly in respect of an incident which took place on 08.07.2025. Investigation is in progress. The statutory right of the police to investigate into the allegations can not be scuttled at this initial stage.
