Learned counsel for the petitioner filed a memo ‘for Being Spoken To’. It is stated that the petitioner has filed this civil miscellaneous petition seeking the appointment of

an Arbitrator to resolve the disputes that had arisen between the parties. By virtue of an order dated 23.06.2025, this Court was allowed the petition and appointed Retd. J.Vishwanath V. Angadi as the Arbitrator. It is stated that, in the meanwhile, the petitioner and the

respondent have resolved their dispute and the respondent has made a payment of Rs.3,37,981/- to the petitioner on 21.06.2025. The said information was not known to the counsel when the matter was taken on 23.06.2025. As such, the counsel for the petitioner did not bring the facts of the settlement before this Court. The dispute between the parties is resolved. Hence, the order dated 23.06.2025 may kindly be recalled and permit the petitioner to withdraw the petition as the parties have settled the matter out of the Court, and due to inadvertence, learned counsel for the petitioner could not inform the Court regarding the dispute resolved between the parties. As the dispute has been resolved between the
